Same sex marriage

October 19, 2008

Before I go into my whole spin on the same sex marriage ban proposition, I felt an obligation to give my readers insight on what exactly is entailed in the proposition (as defined in Ballotpedia)

“Proposition 8, also known as the Eliminates Right of Same-Sex Couples to Marry Act, will appear on the November 2008 ballot in California. It was previously titled the Protect Marriage Act. It has also been known as the Same-Sex Marriage Ban or the Limit on Marriage Amendment. If it passes, it will add a new constitutional amendment to the California Constitution that will have the following text: “Only marriage between a man and a woman is valid or recognized in California.” The ballot title for the measure says that Prop. 8 “eliminates the right of same-sex couples to marry”.

California first explicitly defined marriage as a state between a man and woman in 1977.[6] That year, the California State Legislature passed a law that said that marriage is a “personal relation arising out of a civil contract between a man and a woman”. In 2000, voters passed ballot initiative Proposition 22 with a margin of 61%, which changed the California Family Code to formally define marriage in California between a man and a woman. Prop. 22 was a statutory change via the initiative process, not a constitutional change via the initiative process.

In 2004, San Francisco Mayor Gavin Newsom performed same-sex marriages in his city, which were subsequently judicially annulled. This case, and some others, eventually led to a May 15, 2008 decision of the California Supreme Court, which by a 4-3 vote struck down Proposition 22.

Prior to the May 2008 state Supreme Court decision, opponents of same-sex marriage had already begun their efforts to qualify Prop. 8 for the ballot. They reasoned that since Prop. 22 was only a statute, it was more vulnerable to judicial nullification than an amendment to the constitution”

Now, let’s be real about this. This country has always been rather socially retarded when it comes to being progressive socially. I mean, slavery abolished but we still, to this day, have tremendous issues when it comes to race relations. It is so much so that it will play an integral part this coming November. We could potentially have the first African American president in this country’s rich, albeit sordid, history. I, personally think (and hope) it will be a reality.

Now, somehow, we have been able to make tremendous strides in racial equality. Very slowly, but progress nonetheless. Yet, in all our forthrightness in this area, we still are on square one when it comes to the gay and lesbian community. I mean, first they were responsible solely for the spread of AIDS (since disproven as widespread contraction has spread via blood transfusions and heterosexual sexual contact not to mention illegal drug use over the years.).Now they threaten the very sanctity of marriage….WTF?

C’mon, you seen the commercials or rather the misrepresentations, of what will happen if same sex marriage is not abolished. Your kids, my future kids will be taught about mommy marrying mommy and so on and so forth as part of their educational curriculum. Really? Since when?

I may be showing my age here, but I never seem to remember any mention of that in the sex education or child development. Hell, I was in school to learn, not to judge. Not to mention (and I am sure I am not alone), I knew more than a few folks whose sexual preferences were clearly defined early on and are pillars of strength in their respective communities. That being said, does their sexuality make them “less “American than the next man o woman? I think not.

Let’s go deeper. We, as a country, are sexually repressed. We will talk about and curse the specter of same sex marriage. But, deep in our heart of hearts, we are insanely jealous. Not because we want to be a gay man or a lesbian. No, we are jealous because we don’t have the comfort in our sexuality and the moral conviction to stick up for what we believe in. It’s just like our patriotism. We only cling to it when we feel it might be threatened. And that’s bullshit. And for all you “holier than thou” out there, do you honestly think that gay people are any less moral or forthright than you? If you do, you’re a hypocrite

But that’s ok. Keep on spreading a convoluted message; continue to be a false prophet. I am sure that is living in the Lord’s image. But no, let me not do that which I am accusing you of. Let me not be a bearer of bad tidings and a preacher of falsehoods. Everything will play out accordingly. It’s in the Good Book. Oh you missed that part..That’s what I thought. Late
